Terms of Service

These Terms of Service explain the rules for using CallGenie, including account use, AI-assisted booking, calls, SMS messages, subscriptions, billing, acceptable use, early access features, and service limitations.

Important: CallGenie helps users search for businesses, contact businesses, request availability, and manage booking activity. We work to make the service helpful and reliable, but we cannot guarantee that every call, message, business response, or booking attempt will succeed.
SMS disclosure: By providing your phone number and opting in to SMS messages, you agree to receive transactional text messages from CallGenie related to your account, booking activity, appointment requests, confirmations, reminders, security, and support. Message frequency may vary. Message and data rates may apply. Reply STOP to opt out or HELP for help.
Real-world booking notice: CallGenie may help communicate with third-party businesses, but those businesses control their own hours, prices, services, availability, policies, and appointment decisions. A booking should not be treated as final unless it is clearly confirmed through the app, by the business, or through another reliable confirmation method.

1. Agreement to these Terms

These Terms of Service are a legal agreement between you and CallGenie. By accessing or using the CallGenie website, mobile app, AI-assisted booking features, calling features, SMS features, account tools, paid features, or related services, you agree to these Terms.

If you do not agree to these Terms, do not use CallGenie.

2. Who these Terms apply to

These Terms apply to your use of CallGenie’s website, mobile app, communications, account features, AI-assisted booking, calling, messaging, subscription tools, and related services.

If you use CallGenie on behalf of a company, organization, or another person, you represent that you have authority to do so and that you will follow these Terms.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement where you live to use CallGenie. CallGenie is not intended for children or minors.

We may refuse, suspend, or terminate access if we believe a user is underage, using false information, creating risk, or violating these Terms.

4. What CallGenie does

CallGenie is an AI-assisted booking and communication platform. Depending on the feature, user request, business, region, and supported service, CallGenie may:

  • help users search for businesses and services;
  • show business information, hours, contact details, location, service notes, and appointment-related details;
  • place AI-assisted calls or supported communications on a user’s behalf when requested;
  • ask businesses about availability, services, booking requirements, appointment times, and related details;
  • help request, confirm, reschedule, cancel, or track appointments when supported;
  • send booking updates, summaries, reminders, confirmations, status alerts, and support messages;
  • help organize booking history, user preferences, and service activity.

CallGenie is a convenience tool. CallGenie does not own, control, manage, or operate the third-party businesses users choose to contact.

5. Early access and supported availability

CallGenie may be offered as an early access, beta, limited rollout, or region-limited service. Features, categories, service areas, supported businesses, pricing, plans, booking flows, communication methods, and availability may change as the platform develops.

Certain features may be limited by location, provider availability, business response, app version, account status, service category, payment status, legal requirements, or operational capacity. We may add, remove, test, pause, or modify features at any time.

Early access does not guarantee that CallGenie will be available in every city, category, business type, device, platform, or situation.

6. Your account

You are responsible for keeping your account credentials, devices, and login methods secure. You are responsible for all activity that happens under your account, unless caused by CallGenie’s own failure to use reasonable security measures.

You agree to provide accurate, current, and complete information when creating an account, requesting a booking, adding preferences, using paid features, or contacting support.

You must not create fake accounts, impersonate another person, use another person’s contact information without permission, or use CallGenie to submit false, deceptive, or harmful requests.

7. User responsibilities

When using CallGenie, you agree that:

  • you have permission to provide any phone number, email address, appointment details, or personal information you submit;
  • you will review important booking details before relying on them;
  • you will not use CallGenie for emergencies, urgent medical needs, legal emergencies, life-safety issues, or time-critical situations;
  • you will not submit highly sensitive information unless it is necessary for the requested service;
  • you will not use CallGenie to harass, threaten, spam, mislead, defraud, or abuse businesses, users, or third parties;
  • you will comply with all laws, rules, and policies that apply to your use of the service;
  • you understand that third-party businesses may have their own rules, cancellation policies, fees, deposits, payment requirements, and service requirements.

8. Acceptable use

You agree not to use CallGenie to:

  • break the law or violate another person’s rights;
  • submit false, misleading, abusive, harmful, or unauthorized information;
  • book appointments you do not intend to attend;
  • spam businesses or repeatedly send unnecessary requests;
  • harass, threaten, abuse, discriminate against, or impersonate any person or business;
  • attempt to access, scrape, probe, overload, reverse-engineer, disrupt, or interfere with CallGenie or its systems;
  • use bots, scripts, automation, or abusive traffic patterns without permission;
  • use CallGenie in a way that could harm users, businesses, service providers, or the public;
  • use CallGenie to transmit unlawful, fraudulent, harmful, or prohibited content.

9. AI systems and automation

CallGenie uses automated systems and AI-assisted tools to help understand user requests, organize booking details, communicate with businesses, summarize outcomes, personalize parts of the experience, and improve reliability.

AI and automation are not perfect. They may misunderstand, misclassify, omit, or summarize names, dates, times, addresses, services, instructions, availability, prices, business policies, or business responses incorrectly. You are responsible for reviewing important details and contacting the business directly when confirmation is important.

CallGenie may improve AI prompts, booking flows, communication logic, safety systems, and service performance over time. Features may change as the product improves.

10. Calls, messages, and booking accuracy

CallGenie makes reasonable efforts to help complete calls, messages, and booking requests accurately, but we cannot guarantee that every business will answer, respond, confirm availability, honor a booking, or provide complete information.

  • calls may fail, disconnect, go unanswered, go to voicemail, or return incomplete information;
  • messages may be delayed, blocked, undelivered, filtered, or missed by a user or business;
  • business availability may change before or after a booking request;
  • some bookings may require direct confirmation by you or the business;
  • some bookings may require deposits, payment details, forms, insurance details, vehicle details, card-on-file rules, or custom answers;
  • business hours, services, availability, policies, and prices may change without notice;
  • CallGenie may be unable to complete a booking if a business does not respond or does not support the requested action.

A booking should not be treated as final unless it is clearly confirmed through the app, by the business, or through another reliable confirmation method.

11. Booking requests, attempts, retries, and credits

CallGenie may use booking requests, usage credits, call credits, message credits, subscription limits, or other usage systems depending on the plan, offer, or feature shown at the time of purchase. The specific rules for included usage, paid usage, retries, renewals, expirations, and limits will be shown in the app, on the website, at checkout, or inside the applicable plan details.

A booking request may involve one or more actions, such as an AI-assisted call, retry, message, callback handling, confirmation request, rescheduling request, cancellation request, or status update. Not every attempt results in a completed booking.

Unless the plan details state otherwise, failed calls, unanswered calls, voicemail outcomes, disconnected calls, incomplete business responses, user cancellations, unsupported requests, and technical issues may be handled according to the usage and credit rules shown for your plan or offer.

If a booking request appears incorrect, incomplete, affected by a technical issue, or unfairly counted against your usage, you may contact support for review. CallGenie may, at its discretion and where appropriate, provide a retry, correction attempt, credit adjustment, refund consideration, or other reasonable support. This does not guarantee that every failed or incomplete attempt will receive a credit, refund, or successful retry.

12. SMS, email, and app communications

By providing your phone number and choosing to receive SMS messages, you consent to receive transactional text messages from CallGenie related to your account and appointment activity. These messages are used to operate the service and keep you informed about actions you request.

Transactional SMS messages may include:

  • account verification messages or one-time passcodes;
  • booking request updates;
  • appointment confirmations;
  • appointment reminders;
  • business reply notifications;
  • rescheduling or cancellation updates;
  • call status, voicemail, callback, or booking status alerts;
  • security alerts and support messages.

Message frequency may vary depending on your use of CallGenie, your booking activity, and the status of your appointment requests. Message and data rates may apply depending on your carrier and plan.

You can opt out of SMS messages at any time by replying STOP. You can reply HELP for help. You may also contact us at support@supportcallgenie.com.

Opting out of SMS messages may limit or disable certain features, including account verification, booking updates, appointment confirmations, appointment reminders, and time-sensitive service notices.

You are responsible for providing a valid phone number and email address if you want to receive communications from CallGenie. If your contact information changes, you are responsible for updating it.

Our Privacy Policy explains how we collect, use, protect, and share information, including phone numbers and SMS consent information. CallGenie does not sell, rent, or share mobile phone numbers, SMS opt-in data, or SMS consent information with third parties or affiliates for their own marketing or promotional purposes.

13. Business information and third-party businesses

CallGenie may display information about third-party businesses, including business names, addresses, phone numbers, hours, categories, ratings, service details, prices, availability notes, and other public or business-related information.

Business information may be incomplete, outdated, unavailable, estimated, or incorrect. Businesses are responsible for their own services, prices, appointment availability, safety, quality, policies, cancellations, refunds, and customer experience.

CallGenie is not responsible for the actions, omissions, pricing, service quality, appointment decisions, policies, cancellations, delays, or errors of any third-party business.

14. Prices, availability, and service details

CallGenie may show or communicate business information when available, including prices, service ranges, hours, availability, appointment details, cancellation rules, deposits, or service requirements. This information may come from businesses, public information, user activity, service providers, or prior communications.

CallGenie does not guarantee that any displayed or communicated price, service, availability, business detail, or appointment detail is current, complete, accurate, or final. Businesses may change prices, hours, availability, service requirements, and policies at any time.

If price, hours, service information, availability, or confirmation status is important, you are responsible for reviewing the app summary and confirming details directly with the business when needed.

15. Plans, subscriptions, usage, and billing

Some CallGenie features may require payment, including paid plans, subscriptions, usage-based features, premium tools, or add-on services. When you subscribe or make a purchase, you agree to the pricing, usage limits, billing terms, renewal terms, cancellation rules, credit rules, and included features shown at the time of purchase.

  • subscriptions may renew automatically unless canceled before the next billing date;
  • usage limits may apply to booking requests, calls, retries, messages, AI actions, premium tools, or other features;
  • prices, included usage, features, credits, plan names, and plan rules may change in the future;
  • taxes may apply when required by law;
  • if payment fails, we may pause, limit, or cancel access to paid features;
  • some purchases may be managed by app store platforms or third-party payment processors.

You should review the plan details before purchasing so you understand what is included, what may count toward usage, how renewals work, and how cancellations or refunds are handled.

16. Free trials, promotions, cancellations, and refunds

If CallGenie offers a free trial, beta period, promotional credit, launch offer, discounted plan, or limited-time feature, the details will be shown at the time of the offer. We may modify or end promotions at any time, unless prohibited by law.

Unless required by law or clearly stated otherwise, paid fees are non-refundable. You can cancel future renewals before the next billing cycle begins.

If your purchase is handled through an app store platform or payment provider, cancellation, refund, renewal, and billing management may be subject to that platform’s or provider’s rules.

If you believe a charge, credit count, failed booking, or usage outcome was incorrect, contact support so we can review it. Any credit adjustment, refund, or retry support may depend on the plan, purchase method, technical records, provider records, and applicable law.

17. Service providers and technical operations

CallGenie may rely on trusted service providers and infrastructure partners to operate the service. These may support calling, SMS delivery, email delivery, hosting, databases, analytics, maps, business search, authentication, payments, app distribution, customer support, security, AI processing, and other technical operations.

Service availability, delivery speed, call quality, message delivery, business search, AI processing, payment processing, and some features may depend in part on those service providers. We are not responsible for failures, delays, outages, or errors caused by systems outside our reasonable control.

18. Privacy

Our Privacy Policy explains how CallGenie collects, uses, protects, and shares information. By using CallGenie, you also agree to our Privacy Policy.

You understand that using CallGenie may involve processing account information, booking information, location information, call information, message information, AI-generated summaries, device information, payment status information, and support information.

CallGenie does not sell your personal information. We may share limited information only when needed to operate the service, such as contacting the business you choose, delivering calls or messages, processing payments, maintaining security, improving reliability, or complying with law.

19. Intellectual property

CallGenie and its software, design, branding, text, graphics, logos, features, workflows, content, and technology are owned by CallGenie or its licensors and are protected by law.

We give you a limited, personal, non-exclusive, non-transferable, revocable right to use CallGenie only for its intended purpose and only in compliance with these Terms.

You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from CallGenie unless we give written permission or the law allows it.

20. User content and feedback

You may provide booking requests, notes, instructions, messages, feedback, reports, reviews, support requests, or other content through CallGenie. You are responsible for the content you provide.

You give CallGenie permission to use your content as reasonably needed to provide, operate, protect, support, and improve the service. This includes using booking details to contact businesses, generate summaries, provide support, prevent abuse, and improve reliability.

If you provide feedback, suggestions, or ideas, we may use them without restriction or compensation to you.

21. Service changes and availability

We may add, remove, limit, pause, test, or change features at any time. We may also restrict access by region, account status, supported device, platform rules, beta availability, service availability, operational need, or legal requirement.

We do not guarantee that CallGenie will always be available, uninterrupted, secure, accurate, or error-free.

22. Suspension or termination

We may suspend, limit, or terminate your access to CallGenie if we believe you violated these Terms, created risk, submitted false information, misused the service, failed to pay applicable charges, abused businesses or users, caused technical harm, or if we are required to do so by law, platform rules, or service provider rules.

You may stop using CallGenie at any time. Some information may be retained as described in our Privacy Policy.

23. Disclaimers

CallGenie is provided on an “as is” and “as available” basis. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and uninterrupted operation.

CallGenie does not guarantee that a business will answer, respond, accept a booking, honor an appointment, provide a specific service, keep a price, keep a time slot, accept a cancellation, accept a rescheduling request, or meet your expectations.

CallGenie is not a medical, legal, emergency, financial, insurance, or professional advice service. Do not use CallGenie for emergencies, urgent health needs, legal emergencies, life-safety matters, or situations where delay or error could cause harm.

24. Limitation of liability

To the fullest extent permitted by law, CallGenie and its affiliates, officers, employees, contractors, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, business opportunities, appointments, expected savings, missed services, business disputes, third-party business actions, or failed booking outcomes arising out of or related to your use of the service.

To the fullest extent permitted by law, CallGenie’s total liability for any claim related to the service will be limited to the amount you paid to CallGenie for the service in the three months before the event giving rise to the claim, or one hundred U.S. dollars, whichever is greater.

25. Indemnification

You agree to defend, indemnify, and hold harmless CallGenie and its affiliates, officers, employees, contractors, partners, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the service, your content, your booking requests, your violation of these Terms, your violation of law, your misuse of calls or messages, or your violation of another person’s rights.

26. Laws and disputes

These Terms are governed by the laws of the State of Minnesota, except for its conflict of law rules, unless applicable law requires a different governing law.

Before starting a formal legal claim, you agree to contact us first so we can try to resolve the issue informally.

27. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the app, by email, through our website, or by another reasonable method.

Your continued use of CallGenie after the updated Terms become effective means you accept the revised Terms.
